Greetings,
I have a pending 485 application under EB3 category through my wife's application. However, recently her employer applied for the EB3-EB2 change since she already qualifies for EB2. I understand that the priority date remains the same. In our case the priority date is Feb 05. I wanted to know what will be the process going forward. Currently the EB3-EB2 application is on the PERM labor state. Once that gets approved does it mean that our I485 will be adjudicated immediately since for EB2 the priority date has already gone past ours (feb 05)? Or we will need to then apply for another I-140?
If anyone knows the process of EB3 to EB2 transfer can he/she kindly post it?

You have to apply a new I-140 for the EB2 only then you can interfile with I-485.

Just by having papers or reco letters is not good enough for NIW. Infact NIW is made tougher in recent times. Proving that work is in national interest in the most difficult part and cases are rejected due to this reason. If you are from India NIW would only save you couple of months of PERM work. EB2 is retrogressed. NIW was useful when labor certifications used to take sevaral years. If you are from india and you think you are really extraordinary and exceptional in your field, then go EB1. It is current now.if you have to apply in EB2 only then use the perm process. It is fast now.

A friend of mine is a citizen from a non Visa-waiver country, married to an American. They've been married for two years and she is expected to receive her green card in a few months at the embassy of her country of origin where she still lives. Because of abuse issues, she wants to separate asap but is afraid he might retaliate by trying to prevent her from receiving her green card. Is that possible, or should she wait until she has the Green Card in her hands? Thanks!

I have started a thread with similar message. Giving GCs to us means atleast another 10,000 home purchases = $3 billion. A few people here supported that idea, a few vehemently opposed and few was kind of neutral.
Worth pursuing in my opinion.
I am suggesting we should write to White House and to the Ben Bernanke in Mass and draw their attention towards a million people waiting for their green cards, logically they should have already got it(10 years waiting is illogical) but if USCIS use Visa recapture these people can get green cards and green cards to these people means a million new house buyers in the market new cars buyers etc etc. Everybody is going to get green card one day, why not now..That will help bail out the housing market. I'm sure it'll strike a cord with the lawmakers as it will benefit them politically....

picked up a rebel a few months ago, but just got around to using it recently.

I don't recall the exact settings off hand, but the lense is a cheap canon
75-300mm I picked up for $200 bucks. I believe it was shot at F5.6@ 300mm
with a 1/40 shutter on a tripod.

My friends received Green cards in 2007. They live abroad, but make regular trips tho the Us to visit family and maintain their GC.
Unfortunaltely, they recently misplaced their green cards. They are planning a trip to the US this month, for which they have received travel letters from the US Embassy abroad.
Would anyone know what the process is afterwords? We know they have to file I-90s to replace their lost GC. Does this have to be done at the port of entry? Or is it done at a local office on reaching their final US destination?
Also, will they be called for a biometric appointment locally or can that be done at a Port of Entry. Can the biometric be done at a location abroad?
If anyone has any info on this, it'd be truly appreciated.

You can also extend the H1b...if your labor is filed 365 days prior to your H1b expiraton...
You are looking atleast 21 months into future...there are so many things that can happen...
140 rejection may not be an issue... but in case your worst fear comes true...you will be alright if it's rejected before feb 2008.
Even then there are other ways around this problem...

Can anyone tell me after my 6th year of H1 i have a 3 year extension of h1 visa, can i go to india and come back on that visa or do i need to have AP. I got my 140 approved and i got my 485 receipt notices.
you can use the visa, need not use AP if you dont want to. If you have a visa stamping already, using the H1 visa is the preferred way to return:
- you get an I-94 valid for 3 more years (with AP you get one for just one year, which is a bit weird)
- using AP atleast sometimes pushes you into secondary inspection which is another hour spent with the customs and border patrol folks. While they are typically nice and friendly, I personally hate being stuck in that no-mans land at the airport.
Only advantage of AP is if your GC is approved while you are abroad, you are supposed to return on AP as your H1 status would have ended. in practice people have re-entered on H1 in such cases and its been ok. Depending on your PD this may not may not be a concern

I'm a July 2007 filer going to file for my EAD for the first time. Since I'm currently on H1B, how should I answer this question
I'm applying for:
a) Permission to accept employment
b) Replacement
c) Renewal of my permission to accept employment
I think I need to go with option "c" since moving from H1B to EAD would qualify for a "c" response
Please advise.....

In G-325, there is one column for "Applicant's residence last five years".

Hi,
I am working for campany A on H1B visa. Company A sponsored my GC. My I-140 & I-485 are pending. I am offered a full time job at company B. Company B is not willing to apply for H1B, so i have to use my EAD. My current employer (Company A) agreed to let me go and supportive of my decision.
Question: If i use my EAD to join company B without informing USCIS, and at later point join my sponsoring employer (Company A) on same H1b which i have right now will it be a issue ?
Is there any way USCIS coming to know that i switched employees in between.
